CREA Y CRECE LAW

The Crea y Crece Law makes electronic invoicing mandatory. But don’t worry, with Ediversa Group everything is under control.

The Crea y Crece Law aims to transform invoicing in Spain. Its goal is clear: boost digitalization, modernize businesses, and reduce late payments. One major change will be mandatory electronic invoicing for all companies and freelancers, regardless of size or sector. This improves payment traceability, reduces late payments, and facilitates interconnection between platforms and providers.

Pending its definitive implementation, once the final regulation is published, companies with annual revenue over €8M will have 1 year to implement it, while others will have a 2-year gradual implementation period.

NEW RULES

VERIFACTU SYSTEM

Verifactu requires Certified Billing Systems and automatic record submission to the Tax Agency (AEAT). Don’t worry, our protocol keeps it under control.

The Anti-Fraud Law (11/2021), promoted by the Tax Agency, strengthens fiscal transparency and digitalization. Its key tool, Verifactu, requires certified Billing Information Systems (SIF) connected to the AEAT, which send information automatically. This prevents data manipulation and ensures traceability and integrity. Key dates:

January 1, 2026

July 1, 2026

Freelancers

Affects all software providers, companies, and professionals in Spain, except those under SII.

What is the Crea y Crece Law?
It is a regulation that requires all companies and freelancers in Spain to issue electronic invoices for commercial transactions. Its goal is to promote digitalization, increase efficiency, and ensure greater transparency in transactions.
When will the Crea y Crece Law come into effect?
We are currently awaiting the final publication of the Law's Technical Regulation. Once published, the implementation period for electronic invoicing will be 1 year for companies with annual revenue over €8M and 2 years for companies with annual revenue under €8M.
What is the Verifactu system?
It is a technical and legal framework requiring invoicing software to be certified and automatically send invoice information to the Tax Agency. This helps fight fraud and ensures the authenticity of issued invoices.
When will the Verifactu system come into effect?
2026 is the year Verifactu is implemented, with two key dates: January 1, 2026 for companies and July 1, 2026 for freelancers.
How do these regulations affect my company or office?
If you are a freelancer or run a company in Spain, from the enforcement of the Crea y Crece Law you will be required to use electronic invoicing in your commercial transactions. If you use a billing system (SIF), it must comply with Verifactu requirements.
